The automotive industry continues to move towards an internet-based selling model to provide innovative and accessible customer experiences. As a result, OMVIC has released a guideline outlining how to best comply with existing legislation and regulations in online vehicle sales.
OMVIC has consulted the industry and worked with registrants to assess how to best ensure a fair operating environment that meets business needs and protects consumers’ interests through an online selling platform. This guideline reflects the input received and offers further clarification surrounding online sales.
What does this guideline contain?
In summary, the online sales guideline:
- States that companies and individuals engaged in online sales are subject to the same rules, requirements, and expectations as other registrants.
- Reiterates the key requirement that all dealers and salespeople must be registered with OMVIC.
- Provides advice on areas such as registration requirements; contract language and provisions; disclosure requirements; maintenance of business records; test drives; cooling-off periods; place of business and associated signage; advertising; and the role of the Code of Ethics.
OMVIC will be hosting an informational webinar to address any questions or comments on Wednesday, December 14th at 12:00 p.m. Click here to register through Zoom.
Note: This information was created to assist dealers/salespeople and is not a legal document. Registrants are encouraged to obtain independent legal advice.
