Note: Some of the persons convicted for unregistered selling (curbsiding) may have subsequently sought registration as a motor vehicle dealer.

Conviction-Guilty Plea: individual has admitted to the charge(s)

Conviction-Trial: a trial was held and a finding of guilt was made

Fine: sum of money ordered to be paid

Fine & Incarceration: a sum of money ordered to be paid as well as a term of imprisonment

Fine & Probation: a sum of money ordered to be paid and a period of supervision to be carried out over the convicted individual instead of serving time in prison

Fine & Restitution: a sum of money ordered to be paid and property or monetary value to be returned to the victim/proper owner

Incarceration: term of imprisonment

Incarceration & Probation: term of imprisonment followed by a term of probation

Incarceration & Restitution: term of imprisonment and property or monetary value to be returned to the victim/proper owner

Probation: period of supervision over the convicted individual instead of serving time in prison

Restitution: either property or monetary value to be returned to the victim/proper owner

Suspended: period of delayed sentencing after the individual is found guilty

Suspended & Probation: period of delayed sentencing after the individual is found guilty to allow the individual to serve a period of supervision rather than time in prison

Suspended & Restitution: period of delayed sentencing after the individual is found guilty and property or monetary value to be returned to the victim/proper owner

Related legislation

Section 27 of Ontario Regulation 333/08 of the Motor Vehicle Dealers Act (MVDA) requires OMVIC to make certain information available to the public including information related to charges (under the MVDA or the Consumer Protection Act) laid by OMVIC Investigators against registrants (dealers and salespeople) and convictions if registered. Additionally, OMVIC is required to make available information that could assist in protecting the public in relation to persons who trade in motor vehicles without benefit of registration (i.e. curbsiders – illegal, unlicensed dealers).
