Call for Applications for OMVIC’s Discipline and Appeals Tribunals

OMVIC is now accepting applications from experienced leaders in the motor vehicle industry for positions on its Discipline and Appeals Tribunals.

Open Positions

We are currently looking to fill four positions. We are seeking: 

  • Directors or officers of new or used car dealerships 
  • Registered salespeople from new or used car dealerships  

Tribunal members will be appointed for three-year terms beginning in November 2024, with the possibility of renewal for a maximum of nine years. The commitment is one to three hours per month, primarily virtual, and may vary based on disciplinary activity.

About OMVIC

OMVIC is a not-for-profit corporation responsible for regulating motor vehicle sales in Ontario by administering and enforcing the provisions of the Motor Vehicle Dealers Act, 2002 (MVDA) and its regulations. OMVIC’s mandate is to maintain a fair and informed marketplace by protecting the rights of car buyers, enhancing industry professionalism and ensuring fair, honest and open competition for registered motor vehicle dealers. 

Role of the Discipline and Appeals Tribunals

In support of OMVIC’s commitment to industry professionalism, the Discipline and Appeals Tribunals handle cases involving registrants’ violations of the Code of Ethics and independently address issues brought forward by OMVIC’s Registrar.

To Qualify

If you’re interested in joining OMVIC’s Discipline and Appeals Tribunals, you must:  

  • Be a registrant in good standing with OMVIC. 
  • Understand the MVDA and its rules, including the Code of Ethics. 
  • Be a person with good character, honesty, and financial responsibility. 
  • Be skilled in analyzing, writing, and speaking effectively. 
  • Have the ability to stay neutral and impartial during discipline proceedings. 
  • Be committed to maintaining fair and transparent processes. 
  • Not have a history of being disciplined under the Code of Ethics or convicted of industry-related offences. 
  • Have been registered under the MVDA for at least two years before joining the Discipline and Appeals Tribunals. 
  • Support consumer protection and industry professionalism. 
  • Be willing to cooperate fully with an inspection of your business premises or financial records to ensure compliance with the MVDA and its regulations.

Commitment

Tribunal members are appointed for three-year terms. Unless otherwise indicated, individuals are appointed to serve on both Tribunals. The Tribunals meet on an ad hoc basis throughout the year. The time commitment for serving on the Tribunals is typically one to three hours per month, primarily virtual, and may vary based on discipline activity.  

Compensation

These part-time positions offer per-day compensation, with reasonable expenses covered, subject to OMVIC’s Board Remuneration Policy and Travel and Meal Expense Reimbursement Policy. 

Selection Process

The Governance and Nominating Committee of the OMVIC Board of Directors, guided by the Discipline and Appeals Tribunals Terms of Reference and Skills Matrix, will review all applications, and interviews and background checks will be conducted with shortlisted candidates if required. Qualified candidates will be recommended to the OMVIC Board of Directors for appointment.
